1. Acceptance of Terms
By creating an account, or by accessing, downloading, installing, or using the Magic Carpet mobile application, website, browser-based tools, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service (the "Terms").
By creating an account, you affirm your acceptance of these Terms. If you do not agree to these Terms, you must not create an account, access the website, or use any part of the Services.
2. Nature of the Services
Magic Carpet Technologies Inc. provides software tools across mobile and web interfaces designed to assist users in optimizing travel itineraries and predicting wait times or crowd levels.
- Non-Affiliation: Magic Carpet Technologies Inc. is an independent entity. We are not affiliated with, endorsed by, authorized by, or sponsored by the Walt Disney Company, its subsidiaries, or any other theme park operator, entertainment venue, or travel destination mentioned within the Services.
- Predictive Data: All wait times, crowd levels, and itinerary optimizations are estimates based on historical data, mathematical optimization models, and predictive algorithms. They are "predictions," not guarantees.
3. Disclaimer of Warranties & "As-Is" Service
THE SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Accuracy & Reliability: We do not warrant that the predictions, schedules, or optimizations provided will be accurate, complete, or reflect real-time conditions at any given moment. Travel conditions, weather, ride maintenance, and crowd patterns change rapidly.
- Technical Availability: We do not guarantee that the mobile application or browser version of the Services will be uninterrupted, secure, or entirely error-free. You acknowledge that software bugs, data feed disruptions, or server outages may occur on both desktop and mobile platforms.
4. Limitation of Liability
Magic Carpet Technologies Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of, or inability to use, the Services. This includes, but is not limited to:
- Vacation & Travel Impact: Magic Carpet is a planning tool, not a travel guarantee. We are not responsible if the data or recommendations lead to missed reservations, long wait times, logistical delays, or a perceived "ruined" vacation experience.
- Third-Party Actions: We are not responsible for changes in park hours, unscheduled ride closures, special events, or policy changes made by third-party travel destinations.
- User Reliance: You use the information provided by the Services entirely at your own risk. Final travel decisions should always be cross-referenced with official real-time information provided directly by the destination venue.
5. Intellectual Property
The Services, including all mobile and web source code, design elements, proprietary optimization algorithms, heuristics, and original content, are the sole property of Magic Carpet Technologies Inc. Users are granted a limited, personal, non-exclusive, non-transferable, and revocable license to access and use the Services for personal, non-commercial purposes.
6. User Conduct & Restrictions
Users agree not to:
- Attempt to reverse engineer, decompile, or extract the source code or underlying algorithms of the mobile application or website.
- Use automated scripts, bots, spiders, or "scraping" tools to systematically extract data from the Services.
- Circumvent any rate limits, user authentication systems, or security features of the mobile app or web platform.
7. Governing Law
These Terms and any disputes arising out of or related to the Services shall be governed by and construed in accordance with the laws of the Province of Nova Scotia and the federal laws of Canada applicable therein.
